Witness describes death of Danyel Borden in second day of murder trial for Dustin Boggs

MIAMI, Okla. — Arturo Council described for a jury today how Dustin Boggs attacked and killed Danyel Borden a year ago on an Ottawa County road.

Council, the state’s key witness, testified at length this morning on the second day of Bogg’s trial in Ottawa County District Court.

Boggs, 25, is charged with first-degree murder in the death of Borden, 21, on June 14 of last year. Borden was stabbed and shot to death.

Council said he watched Boggs at first attempt to strangle Borden with a cord inside the car in which Council was giving the couple a ride. He told the court that the attack surprised him so much that he slammed on the brakes and Borden was able to break free of Boggs and jump out of the car. Council testified that Boggs then jumped out after her and got her down on the road and was punching her, apparently, with a knife in his hand, although Council said he never actually saw the weapon.

Council said he tried to come to Borden’s defense but Boggs held him off with a knife and threats to kill him if he didn’t back off. He went on to tell the court how Boggs then shot Borden while holding him at bay with a gun.

Defense attorneys are expected to begin their cross-examination of Council this afternoon.
