Boggs convicted, receives life term

MIAMI, Okla. — A jury has convicted Dustin Boggs of the murder of Danyel Borden and decided that he should receive a life sentence.

Jurors deliberated about 50 minutes before returning the guilty verdict and sentence at the conclusion of a four-day trial in Ottawa County District Court.

Borden, 21, formerly of California, was stabbed and shot to death the afternoon of June 14, 2012, on County Road 610 outside Miami. The prosecution maintained that Boggs, 25, attacked his ex-girlfriend and fiancee in a violent rage in front of an eyewitness, Arturo Council, who testified against Boggs at the trial.

District Attorney Eddie Wyant expressed satisfaction with the jury’s verdict and sentencing decision.

“I’m happy Danyel’s going to get some justice and he’s going to be off the streets for about 40 years or so,” Wyant said.

Under Oklahoma law, a defendant convicted of first-degree murder in a case where the death penalty is not sought must be given either a life sentence or life without parole. They must serve 85 percent of a life term, which is calculated at 38 years and three months in Boggs’ case.
