Sex offender granted probation after plea bargain

A 34-year-old defendant pleaded guilty Friday in Jasper County Circuit Court to residing too close to a school as a convicted sex offender and was assessed a suspended sentence.

Jason L. Buller pleaded guilty to the offense in a plea agreement with the Jasper County prosecutor’s office that dismissed two related charges that he was facing and limited the prison time that he might receive to four years. Circuit Judge David Mouton accepted the plea deal and assessed Buller four years, but suspended execution of the sentence and placed him on probation for five years.

Buller has a conviction in Jasper County for first-degree sexual misconduct and is required by state law to register as a sex offender. He also is prohibited from living within 1,000 feet of a school.

A probable-cause affidavit states that the Jasper County Sheriff’s Department notified Buller on Dec. 11 that his residence at 418 N. Tennessee St. in Carterville was too close to a school and that he needed to move. When he failed to move by Jan. 17, he was arrested and charged.

Buller more recently was charged with a second count of the offense and a count of failure to register as a sex offender. Those were the two counts dismissed in the plea deal.
