A judge granted a Joplin man a suspended sentence this week on a weapon conviction in Jasper County Circuit Court.
Brandon L. Jackson, 29, pleaded guilty Nov. 28 to a reduced charge of unlawful use of a loaded firearm while intoxicated. Jackson initially was charged with first-degree assault in the case involving a gunshot fired outside a bar in downtown Joplin.
Circuit Judge David Dally assessed Jackson four years for the conviction, but suspended execution of the sentence and placed him on supervised probation for five years. The judge also dismissed related counts of tampering with a witness and unlawful use of a weapon that Jackson was facing.
A probable-cause affidavit states that Jackson got into a fight Nov. 28, 2010, with an employee of the bar at 502 S Joplin Ave. known at the time as Club 502. The employee, Jason Maxey, told police that Jackson pulled a gun out of his waistband and the weapon went off as Maxey tried to take it from him.
Jackson’s plea agreement with the Jasper County prosecutor’s office limited the prison time he might be assessed to no more than four years and called for the dismissal of the other two felony counts.
Court documents state that Jackson picked up the other charges by allegedly pointing a gun at Maxey at a car wash on March 15 of last year and displaying a weapon to him again the next day while the two were sitting in separate vehicles at a red light.
