Prosecution drops charge; absence of victim cited

The Jasper County prosecutor’s office has dropped prosecution of a felony assault charge against a 34-year-old Joplin woman.

Rikki R. Tuggle was scheduled to have a preliminary hearing Wednesday in Jasper County Circuit Court on a charge of second-degree assault. Assistant Prosecutor Kimberly Fisher said the charge was being dismissed because of the alleged victim’s failure to show up to testify against the defendant.

Tuggle was accused of attacking Michael Garner on May 23 of last year near B and Main streets in Joplin. Garner told officers that he was on his bicycle when Tuggle and two unidentified men tackled him and began kicking him. He reportedly suffered a broken clavicle and a fractured rib.

The defendant reportedly told police that she became scared when she saw Garner, and for some unarticulated reason she “just went crazy.”
