Voices: Stop Aquila

I am a member of Stop Aquila in Cass County. I am writing this letter because of Public Service Commission Chairman Jeff Davis’ op-ed (Globe, March 16).
Davis is upset because of a sentence that the appellate court added to their decision two years ago in Cass County vs. Aquila.
The court suggested that Aquila could attempt to seek authority for the South Harper Power Plant after the fact. Since the Public Service Commission does not have authority to grant permission after the fact, Aquila needed to go to Cass County and see if they could work something out. The recent decision from the appellate court holds that the PSC has exceeded its statutory authority by issuing the order. Permission to construct a power plant pursuant to state statutes must be granted prior to construction. As usual, Davis seems determined to have his own way.
