Published June 15, 2007 12:02 am - JAY, Okla. — Two former Jay School District students have settled a federal sexual-discrimination lawsuit against the school district and a former bus driver, court records show. “The terms of settlement are confidential,” said Charles Shipley, a Tulsa attorney representing the students. The suit was filed in 2006 in federal court in Tulsa. Also named in the suit were Doug Spillman, former superintendent; Gary Brewster, former assistant superintendent; Mike Seifried, former principal; and Will Stroud, a former bus driver and maintenance man. The suit was filed in 2006 in federal court in Tulsa. Also named in the suit were Doug Spillman, former superintendent; Gary Brewster, former assistant superintendent; Mike Seifried, former principal; and Will Stroud, a former bus driver and maintenance man. The suit accused the school district and the former administrators of failing to investigate or report allegations of sexual misconduct by Stroud. The school officials were dropped from the lawsuit in an effort to streamline the case and to not confuse the jurors, Shipley said. Superintendent David Schachle declined to comment on the settlement and referred all telephone calls to John Moyer, the school district’s attorney. Repeated telephone calls to Moyer were not returned. Trial had been set to begin June 25. The two students, then ages 18 and 8, testified in depositions that Stroud pulled down the pants of the 8-year-old in front of everyone on a bus, Shipley said. “He (Stroud) also encouraged two juvenile boys to restrain and fondle another juvenile female that is not part of this lawsuit, and told the younger student ‘you’re next’”, Shipley said. The two students in 2003 rode a school bus, of which Stroud was the driver. Stroud also was accused of throwing water on a T-shirt on one of the students and of sexual misconduct, according to the petition filed in the case. The younger student has been in therapy for almost two years, Shipley said. “Three weeks ago, for the first time, she used the term molestation and identified Stroud as her molester,” Shipley said.
