12:56 p.m. DNR director says judicial ruling will stop CAFO construction in Missouri w/ Cole County judge's ruling

A judicial ruling effectively stops construction of CAFOs in the state of Missouri, Doyle Childers, director of the Missouri Department of Natural Resources, said today.

Cole County Judge Patricia Joyce on Monday ruled in favor of Friends of Arrow Rock, an organization that formed to oppose construction of a hog CAFO near the state historic community in central Missouri.

The judge, in siding with the plaintiffs, created a buffer zone with a 15-mile radius around the site and other nearby sites.

Childers, in a telephone interview on Tuesday, described the decision as a sweeping example of judicial activism. He said it is likely the agency will appeal the decision within the next 30 days.

The opponents of a CAFO with 65,600 chickens near Roaring River State Park in Barry County praised the decision on Tuesday, saying the judge had eliminated the threat of more CAFOs being constructed near the park, one of Missouri’s top tourist destinations.
