Attorney seeks criminal defamation charges against Baxter Springs mayor

BAXTER SPRINGS, Kan. — An attorney for six Baxter Springs City Council members opposed to Mayor Jenifer Bingham has filed affidavits in city court seeking misdemeanor criminal defamation charges against the mayor.

The affidavits allege that statements by Bingham on April 24 that she had a photo of council members at a meeting held contrary to the Kansas open-meetings law represent criminal defamation. The statement was made with malice and exposed the council members to public hatred, contempt or ridicule.

A special prosecutor likely will be sought to review the affidavits.
