A 22-year-old man was assessed a suspended sentence Monday in Jasper County Circuit Court in Joplin on a felony conviction for domestic assault.
Circuit Judge David Dally assessed Mitchell C. Callahan, of Goodman, four years in prison on a conviction for second-degree domestic assault, but suspended execution of the sentence and placed the defendant on probation for five years.
Callahan choked his wife, Sandra S. Livingston, until she passed out during a domestic disturbance on Aug. 16, 2008, inside an apartment at 410 S. Wall St., according to a probable-cause affidavit filed by a Joplin police officer.
The defendant pleaded guilty to the charge Sept. 28 in a plea agreement with the Jasper County prosecutor’s office that limited the prison time he might be assessed to no more than four years.
