A Missouri appeals court has upheld a decision of the Joplin City Council that granted a special-use permit to Parker Mortuary to install a crematory.
The crematory permit was opposed by some residents and business owners around the mortuary. Two of those residents, G.W. Jackson and his son, Ryan Jackson, appealed the city’s decision to Jasper County Circuit Court and on to the Missouri Court of Appeals in Springfield.
The Jacksons contended that a number of errors were made in the process of deciding the permit request. They opposed the request with the city saying a crematory would emit toxins that posed health risks and would create foul odors.
They contended that the city’s decision was erroneously made without adequate notice to the public and without following its requirement.
Planning and Zoning Commission did not give residents adequate notice as required by city ordinance of a public hearing on the request and failed to make written findings on the request process, they argued.
A Jasper County Circuit Court judge ruled on the case in October 2008 and the appeals court heard arguments on it in September.
