Baxter Springs Attorney Eddie Battitori said Friday his client, Caleb Byrd, of Riverton, has agreed to the offer from Prosecuting Attorney Michael Goodrich.

COLUMBUS, Kan. - A 16-year-old Riverton student initially charged with felonies in connection with an alleged school-shooting plot at Riverton High School, has agreed to plead no contest to disorderly conduct, a Class C misdemeanor.

Baxter Springs Attorney Eddie Battitori said Friday his client, Caleb Byrd, of Riverton, has agreed to the offer from Prosecuting Attorney Michael Goodrich.

Under the agreement, Byrd would be placed on probation and serve 100 hours of community service. He also would be enrolled in a program that - if he is successful - would allow him to re-enter Riverton High School in the fall.

Battitori said before the plea can formally be accepted that Labette County District Judge Robert Fleming must set a hearing.

Goodrich would only say that negotiations with Byrd and his attorney were under way, but there would be no resolution until a judge signed the order.

Byrd; Andrew Jaeger, 15; Coy New, 18; James Tillman 16; and Robby Hunt, 17, were all implicated in the alleged plot at Riverton High School that authorities claimed was set to take place on April 20. All five were arrested on that day, the anniversary of the Columbine High School shootings in Colorado.

The five initially were charged with felonies by Kansas Attorney General Phill Kline. The attorney general's office in August handed the prosecution back to Goodrich, who reduced the felony charges remaining against each defendant to a single misdemeanor charge of conspiracy to riot. Tillman and Hunt pleaded guilty and were assessed a year of probation and community service.

New, Byrd and Jaeger all pleaded innocent.

Battitori said he believes that Jaeger was offered a similar deal, but a call to Jaeger's attorney, Joanna Derfelt, of Baxter Springs, was not returned on Friday afternoon. Jaeger was scheduled to appear in court on Friday.

Trial

Coy New, the only defendant who is legally an adult, is scheduled for a jury trial on Nov. 27 on the misdemeanor charge of conspiracy to riot.
