MIAMI, Okla. —
An eyewitness told detectives that Dustin Boggs shoved something down his ex-girlfriend Danyel Borden’s throat and then got on top of her and was beating her before grabbing a gun and following her down the road shooting at her.
The 21-year-old California woman’s body was found Thursday afternoon on County Road 610 at East 20 Road, with a gunshot wound to her face and a large cut across her neck, according to a probable-cause affidavit that became available Monday with the charging of Boggs, 24, of Miami, with first-degree murder.
District Attorney Eddie Wyant said an autopsy conducted by the state medical examiner’s office found three types of injury to the victim.
“It looks like the cause of death is going to be a combination of blunt-force trauma to the head, along with the shooting and the stabbing,” Wyant said.
Boggs appeared Monday morning in Ottawa County District Court and was remanded without bond on the charge of first-degree murder. His next court appearance was set for June 28.
The affidavit filed with the charge states that an Oklahoma State Bureau of Investigation agent spoke with Arturo L. Council, 36, early on in the murder probe, and learned that Council was with Borden and Boggs on Thursday and witnessed the killing of Borden.
Council, who told the agent that he knew Boggs by the alias “Manson,” said he and Borden picked Boggs up in Rotary Park in Miami on the day in question and drove north of town. They were in a 2010 Hyundai Accent that belonged to another female acquaintance of Council’s, with Borden sitting in the front passenger seat and Boggs in the back seat.
According to the affidavit, Council told the agent that “for no reason apparent” to him, Boggs “placed some object into Danyel Borden’s mouth and was choking her.” As he was doing this, he allegedly said to Council: “Help me, preacher man.”
Council told the agent that he pulled the vehicle to the side of the road, and Borden got out and tried to get away. But Boggs pursued her, got on top of her and appeared to Council to be hitting her in the chest, the affidavit states.
The witness told the agent that he got out of the vehicle and tried to intervene at that point, and Boggs got off the woman, went back to the car and got in the passenger side of the front seat. Council told the agent that he also returned to the vehicle at that point and got back in the driver’s seat. But Boggs pulled a handgun from the glove compartment, got back out of the car and “followed Danyel down the road shooting at her,” the affidavit alleges.
Council told the agent that Boggs said, “The b---- is up,” and shot at Borden several times before getting back in the vehicle and returning to Miami with Council. Council told the agent that Boggs left him at the home of the friend who owned the car, and drove away with the vehicle.
Boggs was arrested early the next morning at a Miami address, where investigators seized a pair of jeans that appeared to be blood-stained, according to the affidavit. Detectives also found a text message that Borden sent a friend about 1:22 p.m. Thursday indicating that she was in a car with Council and Boggs, and that they were headed out of Miami.
Wyant told the Globe that Council apparently represents himself as a preacher from California. The district attorney said he did not yet know what Borden, Council and Boggs were doing together on Thursday.
According to the district attorney, nothing was found in the mouth of the victim at the scene of the crime, and it remains uncertain what, if anything, the defendant may have put in her mouth. Wyant said he did not yet know who owned the gun used in the shooting.
Council could not be reached for comment on the case.
Car recovered
THE OTTAWA COUNTY SHERIFF’S DEPARTMENT on Sunday recovered the 2010 Hyundai Accent believed to have been involved in the slaying of Danyel Borden. A property owner in the East Grand Lake Shores area reported finding the vehicle, which authorities impounded.
